About The Legal Aid Society and this Website

 The Legal Aid Society is an organization dedicated to advocating for the rights of all New Yorkers.  Since 1876, The Legal Aid Society has been a voice for those who struggle to access justice because of poverty.  This Website provides users with access to a variety of information and resources related to work that we do, including e-newsletters, upcoming events, opportunities to volunteer, information related to legal actions, defenses, claims and processes, and other relevant content (collectively, the “Content”).  The Website also provides a variety of opportunities to support The Legal Aid Society, such as through donating.

 Registration; Personal Information

 You can visit the Website and access some of the Content, features and functionality without being required to provide us with any personal information. However, access to certain Content, features and functionality may require that you provide us with some personally identifying information about yourself, as more specifically detailed in our Privacy Policy, located here.  If you opt to make a monthly, recurring donation, you will also have the option of storing credit card information in order to easily facilitate such future donations, as further described below.

Age Requirements

Features and functions of The Legal Aid Society’s Website that collect personally identifying information – such as features that enable visitors to sign up to receive e-mail messages or newsletters – are intended solely for users who are 13 years of age or older.  Any submission of personally identifying information, such as a name and/or e-mail address, by anyone under 13 is unauthorized.

If you reside in the European Economic Area, Switzerland and the United Kingdom, you must be 16 years of age or older to submit personally identifying information.  Any submission of personally identifying information by a user under 16 who resides in the European Economic Area, Switzerland and the United Kingdom is unauthorized.

The Legal Aid Society Website provides the ability to make an online donation. The Legal Aid Society has engaged the services of third party payment services providers to process all donation/payment transactions; we also engage a variety of other third party providers to solicit and collect funds on our behalf (which third parties are involved depend upon the transaction and the venue in which such transaction is made).  These third party companies manage the routing of applicable customer information through the credit card and electronic check processing networks, as applicable.  The Legal Aid Society is not affiliated with these companies, and we are not responsible in any way for the actions or performance (or lack thereof) of any such company.  Accordingly, The Legal Aid Society expressly disclaims responsibility and liability for all services provided by such third parties, including those related to donation/payment transactions, and you hereby agree that The Legal Aid Society shall not be responsible for any loss or damage of any sort incurred as a result of any such services.

You hereby acknowledge and agree that, for all donations, (1) you will not use an invalid or unauthorized credit or debit card or other payment method; (2) all donations are final and non-refundable. Prohibited Use

 Governing Law And Jurisdiction

These Terms of Use and your access to and use of this Website are governed by and construed in accordance with the laws of the State of New York, without resort to its conflict of law provisions. YOU AND THE LEGAL AID SOCIETY AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS, AND THAT NEITHER YOU NOR THE LEGAL AID SOCIETY WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, A REPRESENTATIVE ACTION, A COLLECTIVE ACTION, A PRIVATE ATTORNEY-GENERAL ACTION, OR IN ANY PROCEEDING IN WHICH YOU OR THE LEGAL AID SOCIETY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.  YOU AND THE LEGAL AID SOCIETY FURTHER AGREE THAT NO PROCEEDING WILL BE JOINED, CONSOLIDATED, OR COMBINED WITH ANOTHER PROCEEDING WITHOUT THE PRIOR WRITTEN CONSENT OF YOU, THE LEGAL AID SOCIETY, AND ALL PARTIES TO ANY SUCH PROCEEDING.

Force Majeure

The Legal Aid Society shall not be liable for any failure or delay in performance due in whole or in part to any cause beyond our reasonable control, or the reasonable control of our contractors, agents or suppliers, including but not limited to utility or transmission failures, power failure, strikes or other labor disturbances, acts of God, acts of war or terror, floods, sabotage, fire, natural or other disasters.
