Berger v. Prospect Park Residence

The Legal Aid Society jointly sued Prospect Park Residence, an assisted-living facility at 1 Prospect Park West, and the State Health Department, on behalf of elderly residents who were unexpectedly given 90 days to move out of the facility so that it could be sold to real estate developers and turned into luxury apartments. The residents – whose average age was 88 years old – required specialized care and attention and should have received individualized transitional support. During the two-year legal battle, services were drastically cut for the elderly residents who remained at the facility. 

In 2016, we entered into a settlement agreement that provided time and money to allow the courageous seniors the opportunity and means to relocate to appropriate housing. Hear the stories of the impacted residents here
