Shepherd v. New York City Housing Authority

The Legal Aid Society brought this lawsuit on behalf of three individual Section 8 participants and a putative class to challenge widespread and known agency delay by the New York City Housing Authority (NYCHA), when Section 8 participants applied for transfer vouchers. NYCHA’s delays led to termination of tenants’ Section 8 vouchers without due process.

In 2014, a federal judge certified the class and approved a settlement agreement requiring NYCHA to timely process requests for transfer vouchers. Additionally, the settlement required NYCHA to proceed with transfer voucher requests and termination of Section 8 benefits separately so that NYCHA could no longer use the refusal of a transfer voucher as a way to terminate benefits without process. The settlement included monitoring provisions.
