The Legal Aid Society brought this hybrid special proceeding on behalf of the Coalition for the Homeless and impacted individuals to challenge New York City’s placement of homeless single adults in congregate shelter settings during the COVID-19 pandemic prior to the vaccine roll out. In response, the Department of Homeless Services (DHS) created Interim COVID Risk Factor Guidelines in order to assess individuals who would be at great risk of serious illness or death in congregate settings, and in order to ensure that those at greatest risk would be placed in less dense settings.
