Bucceri v. Healthfirst

The Legal Aid Society brought this class action lawsuit on behalf of thousands of severely disabled and homebound New Yorkers deprived of needed home care services –– and placed at risk of physical injury and institutionalization –– by New York State and managed care company Healthfirst. The New York State Department of Health contracted with Healthfirst and delegated it the responsibility of administering the provision of home care services to vulnerable New Yorkers enrolled in its plan. Plaintiffs alleged that when indigent and disabled adults asked for an increase in their home care services, Healthfirst either ignored their requests or systematically and unlawfully denied or reduced their needed services.

In 2018, the Department of Health and Healthfirst agreed to adopt new policies, reporting, and review obligations. Formal monitoring of compliance of the settlement terms ended in 2021. Prior to settlement, the case was consolidated with Caballero v. Senior Health Partners.
