M.K.B. v. Eggleston

The Legal Aid Society filed this class action lawsuit to challenge New York City and State’s policy and practice of wrongfully denying immigrants (primarily domestic violence survivors and their children) desperately needed federal benefits, including food stamps, Medicaid, and public assistance. In 2006, after a nine-day evidentiary hearing, we obtained a preliminary injunction. The federal trial judge ordered changes to the City’s flawed eligibility-determining computer system and fixes to the pervasive errors in the City’s training materials and policy directives. In 2007, we entered a settlement agreement which provided for automatic case reviews to thousands of class members denied benefits to determine if they were entitled to retroactive relief, the hiring of 150 immigrant liaisons to process reviews and make future eligibility determinations, and data sharing for us to monitor the City’s efforts. Monitoring remained in effect until 2013.
