LAS: Monitor Report Reaffirms Need for Independent Leadership at City Jails

The latest report from Independent Monitor Steve J. Martin in Nunez v. City of New York, litigation concerning brutality and excessive force in New York City jails, continues to paint a dire picture of conditions for incarcerated New Yorkers, despite claims of progress.

“The cold, hard facts of the Monitor’s own reports contradict his assertion that the New York City Department of Correction has made progress to halt the humanitarian crisis in the City’s jails,” reads a statement from Legal Aid.

Despite court ordered relief, rates of use of force have doubled and New Yorkers continue to suffer deplorable conditions at intake and in other areas of Rikers Island.

It also details numerous ongoing issues with correction staff including a lack of accountability for misconduct and continued abuse of sick leave. The report further questions DOC decisions regarding appropriate staff assignments and promotions for violent officers.

“The Department’s so-called Action Plan has failed,” Legal Aid’s statement reads. “Staying the current course will only harm more and more people condemned to the indefensibly unsafe and inhumane conditions of the City’s jails. We maintain that independent leadership with authority and willingness to enact bold and swift change, such as may be obtained through receivership, is necessary to end this quagmire.”
