• individuals, including derivative family members, who are seeking asylum status, refugee status, withholding of removal, or CAT protection;
• dual nationals traveling on the non-designated country’s passport;
• individuals traveling with a valid nonimmigrant visa in the following classifications:  A-1, A-2, C-2, C-3, G-1, G-2, G-3, G-4, NATO-1, NATO2, NATO-3, NATO-4, NATO-5, or NATO-6;
• any athlete or member of an athletic team, including coaches, persons performing a necessary support role, and immediate relatives, traveling for the World Cup, Olympics, or other major sporting event as determined by the Secretary of State;
  • It is unclear how this interacts with the ban on transgender athletes, under Section 4(c) of the Keeping Men Out of Women’s Sports Executive Order
• *  immediate family immigrant visas (IR-1/CR-1, IR-2/CR-2, IR-5) with clear and convincing evidence of identity and family relationship (e.g., DNA);
  • But any other family members would be subject to the travel ban.
• * adoptees (IR-3, IR-4, IH-3, IH-4);
• individuals with Afghan Special Immigrant Visas;
• ** individuals with Special Immigrant Visas for U.S. government employees; and
• individuals with immigrant visas for ethnic and religious minorities facing persecution in Iran.

Exceptions may be made on a case-by-case basis for individuals who can establish that travel to the U.S.: 

• would advance a critical national interest involving the Department of Justice, including participation in criminal proceedings as a witness; or
• would serve some other U.S. national interest.

• The travel ban seems to limit only physical entry into the U.S.
• It seems that individuals already in the U.S. would still be eligible for adjustment of status (immigrant visas, or green cards) or change of status from one nonimmigrant visa category to another.
• Immigrant visa holders already in the U.S. (permanent residents, or green card holders) who travel abroad should be able to return to the U.S.
• Non-immigrant visa holders already in the U.S. who travel abroad would be subject to the ban when they try to return to the U.S.
