A federal prosecutor on Wednesday called for the overturn of Judge Andrew Carter’s 2019 ruling which found that the government must justify detaining immigrants by proving they represent a risk of flight or a danger to the community when released, according to Law 360.
Immigrant rights defenders argued that the 2019 ruling had upheld due process and minimized the risk of the court issuing faulty denials.
“There’s just no reason to depart from the well established standards about what constitutes a constitutionally adequate bond hearing when someone’s liberty is at stake,” said Julie Dona of the Legal Aid Society, the lawyer of Carlos Velasco Lopez whose removal proceeding generated Judge Carter’s 2019 ruling.
