The Legal Aid Society called on the New York State legislature to reconvene after a ruling by the Supreme Court that blocks part of the State’s existing eviction moratorium, as reported by POLITICO.
The order specifically strikes down the part of the law which protects tenants who have filed a declaration of hardship. However, amending the legislation to allow a hearing on the tenant declaration form will satisfy the legal concerns raised in the high court’s mandate.
“With this decision, one that we adamantly disagree with, state lawmakers must return to Albany immediately to amend and extend the eviction moratorium statute to protect tens of thousands of New Yorkers from imminent eviction,” reads a statement from The Legal Aid Society.
“We hope that our leaders in the Legislature can advance this measure quickly and decisively. The fate of many of our clients, the majority from underserved communities of color, now rests in the hands of Albany lawmakers.”
