The Legal Aid Society, together with Legal Services of New York City, moved to intervene on behalf of tenant groups Make the Road NY, Housing Court Answers, and MinKwon Center for Community Action, in a special proceeding brought by Queens landlords seeking to speed up housing court case processing times, and to curtail tenant protections. The landlords argued that New York renters should be evicted faster, without regard to their ability to raise defenses against eviction or even to participate in court proceedings. Eviction proceedings may not be expedited at the expense of tenants’ due process rights.
The Supreme Court dismissed the landlords’ petition in February 2025, holding that the Housing Court has inherent authority to arrange its own calendars, and that it is not subject to mandamus. Landlord has filed appeal in the Appellate Division, Second Department.
