NYDN: DOI, DOC Investigators Had Access to Privileged Phone Recordings

The Legal Aid Society reaffirmed the need for a citywide audit and an end to the recordings of all phone conversations between incarcerated clients and their attorneys after a New York Daily News report revealed that investigators with the Department of Correction and the Department of Investigation also had access to more than 1,500 protected attorney-client phone recordings, not just local prosecutors as initially thought.

Tina Luongo, Attorney-in-Charge of the Criminal Defense Practice at The Legal Aid Society, called the situation a violation of inmates’ Fifth and Sixth Amendment rights and demanded the city be forthcoming about other agencies or offices that had access to these recordings.

“Given this egregious breach of privacy, we again call for an immediate citywide audit, and on the de Blasio Administration to end the practice of recording these phone calls completely,” Luongo said.
