Deshawn E. by Charlotte E. v. Safir

The Legal Aid Society brought a class action lawsuit on behalf of children arrested on possible delinquency charges who were interrogated by the Family Court Detective Squad. We argued that the Squad’s interrogations were so coercive that they violated our client’s rights to due process and against self-incrimination. The District Court granted summary judgment for the government, finding the Squad’s coercive methods not egregious enough to make out per se constitutional violations. The decision was affirmed by the Second Circuit in 1998.
